CATLETTSBURG —
A South Point man will not face charges in the death of a baby who died in his care last August.
A Boyd County grand jury declined to indict Jerry Schrode Tuesday, said Boyd Commonwealth’s Attorney David Justice.
Schrode, who is currently facing separate child assault charges in Lawrence County, Ohio, had been accused of causing the death of 14-month-old Harlan Watts of Ashland while babysitting in August 2011.
Although the grand jury did not indict Schrode, the case file remains open and if authorities uncover evidence warranting further action they can take it to another grand jury then, Justice said.
Kentucky law prohibits him from revealing grand jury proceedings or commenting on active investigations, Justice said. “But to my knowledge, there is no active investigation,” he said.
He said he got the case from state police in April and waited until now in hopes more information would come to light.
State police spent hundreds of hours over several months investigating the case Justice presented to the grand jury.
Schrode was jailed in Ironton last week on felonious assault charges, accused of assaulting his 6-month-old daughter and is scheduled to appear in court there Friday.

Not guilty plea in death of Boyd baby
A Powell County teenager accused in the beating death of an infant pleaded not guilty to the charge Friday.
Brett T. Thompson, 18, of Stanton was arraigned Friday in Boyd County Court.
