GRAYSON —
Former Olive Hill Mayor Danny Sparks was arraigned in Carter Circuit Court on Monday.
Sparks, 56, was indicted in February on one count of trafficking marijuana, a Schedule I controlled substance, within 1,000 yards of a school, a Class D felony.
He plead not guilty to the charge on Monday, and a pretrial conference was set for 9 a.m. May 20.
Commonwealth’s Attorney Brandon Ison offered a plea agreement which would have Sparks serve 30 months in exchange for a guilty plea.
Probation sometimes is offered in cases where the Class D felony is a first offense. However, that option has not been recommended in this case.
Sparks was arrested Nov. 28 near Olive Hill Elementary School after an investigation by the FIVCO Area Drug Enforcement task force.
He resigned shortly after his arrest and was replaced by longtime City Council member Kenny Fankell.
Sparks will have until his pretrial conference to decide if he will accept the plea agreement and change his plea to guilty. If not, a trial date will be set. He remains free on bond.
